In Nitro-Lift Technologies, L.L.C. v. Howard, the United States Supreme Court reversed a decision by the Oklahoma Supreme Court. The Supreme Court held that the Federal Arbitration Act has supremacy over a state law that limits the enforceability of non-competition agreements. By declaring the non-competition agreements in two employment contracts null and void, rather than leaving that determination to arbitration as set forth in the contracts, the state court ignored a basic tenet of the Federal Arbitration Act. As such, the Supreme Court reversed the ruling by the Oklahoma Supreme Court.
